Fort Denaud, FL

Serving Fort Denaud

Hendry County publishes no tree removal permit, and the Lee-Hendry gate charges more for a Hendry load. What tree removal in Fort Denaud actually involves.

Fort Myers Tree Removal Pros has handled tree-removal in Fort Denaud for more than twenty years, and the first thing we tell an owner here is which government actually regulates the tree. Fort Denaud is unincorporated: no city hall, no council, no municipal tree ordinance, no municipal arborist. The Hendry County Board of County Commissioners is the general-purpose local government at every address here.

That matters because our service map crosses four counties and four separate tree-permit regimes, and the Hendry County one is the least like the rest. The county’s published set of land use applications contains no vegetation permit at all.

It also changes the money. The disposal gates a crew works out of here belong to Lee County Solid Waste, whose rate card prices material by the county it came from, so a load leaving this address costs more than the identical load from a few miles west.

A published application list with no tree permit in it

When an owner asks which county form comes before a removal, the honest answer here is that there does not appear to be one. We say so plainly instead of inventing a process, and we are as plain about what we could not verify.

Twenty-four applications, and not one for vegetation

The Hendry County Planning and Zoning Department, at (863) 675-5220, administers zoning, the land development code and the comprehensive plan for the unincorporated county, and publishes its land use applications as a set of twenty-four documents: lot split, variance, vacation, special permit, special exception, site development plan, rezone, medical hardship, large lot subdivision, comprehensive plan amendment, subdivision plat review, minor spoil removal, temporary use and the rest.

Not one of the twenty-four is a tree removal, vegetation removal or land clearing application. That is a searched negative rather than an assumption, since a published application set is where such a form would live. We could not read the code text itself first-party, so we quote no numbered provision from it and borrow none from the county next door.

The one tree rule certainly in force

Florida Statutes section 163.045 binds Hendry County as it binds every local government in the state. Where a property is a single-family detached building on a lot actively used for single-family residential purposes, and the owner holds signed documentation from an ISA-certified arborist or a Florida licensed landscape architect that the tree poses an unacceptable risk, the county may not require a notice, application, approval, permit, fee or mitigation, and subsection (3) bars any replanting requirement.

There are 374 owner-occupied one-unit detached homes in this census-designated place, which is the shape of most residential work here. The statute reaches neither agricultural land nor the 161 units that are boats, recreational vehicles or vans. We write a dated condition report on any tree we recommend removing regardless, and it says as readily when a tree should stay and what a cable or directional pruning would cost instead.

No tree contractor license exists to check

Florida issues no state tree or arborist contractor license at all, and section 163.211 preempts local occupational licensing, so Hendry County cannot issue one either; pre-2021 grandfathered local licenses expired on July 1, 2025. We say that outright rather than printing a word that implies a credential nobody in this trade holds.

What can be verified is ISA certification plus current general liability and workers’ compensation. ISA certification is the statutory gatekeeper as well as the professional one, since only an ISA-certified arborist or a Florida licensed landscape architect can sign the documentation section 163.045 turns on. Ask for those, and for work specified to ANSI A300 and performed under ANSI Z133.

Why the same gate charges more for a Hendry load

Disposal is the line most quotes bury inside a lump sum, and on this side of the county line burying it costs the owner real money. The rate is set by where a load originated rather than by what is in it.

Hendry horticulture at $48.92 a ton

Lee County Solid Waste’s FY26 schedule lists, at the location code for the Lee/Hendry Regional Solid Waste Disposal Facility, HENDRY HORTICULTURE at $48.92 per ton against a $15.00 minimum, directly alongside LANDFILL HORT at $43.92 per ton on the same minimum. Same scale, same gate, same chipped wood; five dollars a ton for having originated in the county the landfill sits in.

The pattern runs down the table. Garbage is $95.28 a ton Hendry-origin against $69.83 Lee, construction and demolition debris $75.25 against $70.25, landfill sand $90.00 against $85.00. A removal that fills a roll-off across two or three classes pays the premium on each.

The nearest gate stages material rather than burying it

The closest gate to a job here is the LaBelle Transfer Station at 1280 Forestry Division Road, and it is a staging point rather than a disposal site: Lee County Solid Waste states that at the Lee/Hendry transfer stations no waste is disposed of at either facility. Both stations take municipal solid waste, construction and demolition debris and horticulture waste.

The Clewiston Transfer Station sits at 1350 S Olympia Street, and the regional disposal facility at 5500 Church Road in Felda is Lee County’s landfill sited inside Hendry County. That is how one county’s rate card governs another county’s brush, and why hauling and disposal get their own line on our estimates.

A 35-gallon can against what a removal produces

Residential collection in the unincorporated county is franchised to Waste Connections, Inc., named by the county as servicing Hendry County and the City of LaBelle, and administered by Hendry County Special Districts under County Ordinance 88-9. Yard waste goes out in a 35-gallon can, plastic bags, or bundles no more than four feet long and four inches in diameter, none over forty pounds, with pickups on Wednesday.

A single mature limb is already past every one of those limits. The county also treats hauling waste for remuneration or other consideration in any form as a franchise matter under its own ordinance, so the material leaves on a truck and through a gate rather than stacking at the road.

Who responds and who enforces on an unincorporated parcel

Emergency response and code enforcement look different here than a county west, and owners are regularly surprised by which body holds jurisdiction. Neither one is a city department, because there is no city.

A county department, not an independent fire district

Fire response and emergency medical service come from a single county department that names itself Hendry County Public Safety (EMS & Fire) and states that it covers 1,190 square miles with 5 ALS Ambulances as an advanced life support 911 response and transport service. There is no separately constituted fire control district here with its own elected board and its own millage.

Fire protection in the unincorporated county is organized through the county’s special district structure instead. The government that would respond to a tree across a driveway is therefore the same government that publishes no application for taking that tree down beforehand, which is worth understanding before a storm rather than during one.

Special districts drawn around a specific need

Hendry County Special Districts states the structure directly: a special district or MSBU/MSTU is a designated area where there is a specific need, such as lighting, drainage, road maintenance, recreation, fire protection, waste management or mosquito control. Waste collection, lighting, roads and drainage, recreation, mosquito control and the East Hendry County Drainage District all report into that one department.

Whether a particular parcel falls inside any given unit is not something we will assert, because no boundary we could read says so. When an assessment or a drainage easement bears on access for a crane or a chipper, we send the owner to the department rather than guess.

What an unremoved pile would be called

Hendry County Code Enforcement publishes the complaints it handles for the unincorporated county: junk-like conditions and debris, inoperable vehicles, trash in the right-of-way, exterior storage on vacant lots, construction or repair without a permit, and property maintenance. No heading on that list mentions trees, vegetation or overgrowth.

The practical reading is that storm brush left at the road is a debris question rather than a tree question, and that debris in the right-of-way and junk-like conditions are the two headings it would land under. Clearing the material sits inside the job we quote.

What actually changes about the work here

The Caloosahatchee runs through the center of this census-designated place, State Road 80 forms its southern edge, and the fort it takes its name from went up in 1837 as a Second Seminole War supply depot on land owned by Pierre Denaud, a French-Canadian trapper. Regulation is only half of what makes ground like that different to work on.

The water table, not a hardpan, ends the grind

Twenty-plus years on this coast is mostly twenty-plus years of learning where the machine stops. The named soil map units under any particular address here were not something we could establish first-party, so we describe the regional pattern rather than your parcel: in the Southern Florida flatwoods and lowlands the limiting layer is a hardpan and a shallow seasonal water table rather than bedrock.

The Immokalee series places its spodic horizon at 30 to 50 inches, with the water table within 6 to 18 inches of the surface for one to four months in most years. On a river flat that means a broad, shallow root plate in saturated sand: the grinder works wet, and the months the table runs highest are the months a mature tree is least anchored.

Roughly one dwelling in six is a boat, RV or van

161 housing units here, 17.2 percent of the entire stock, are boat, recreational vehicle or van units, which is a different drop zone from a subdivision. Light-gauge awnings, carports and screen rooms fold under a limb rather than dent, stored boats and trailers sit where crane mats want to go, and hookups and tie-downs are at grade where an outrigger lands.

It cuts the useful way too: a unit can be moved before a removal where a house cannot, and moving one is usually cheaper than the rigging needed to work over it. The rate card carries the class outright, at HENDRY BOAT/RV, $99.83 per ton.

A different weather office than the Lee County side

The National Weather Service point lookup for this place returns forecast office MFL, Miami, with public zone FLZ066, county zone FLC051 and fire weather zone FLZ266. Lee County addresses a few miles west sit under the Tampa Bay office in public zone FLZ265 and county zone FLC071.

That is a County Warning Area boundary rather than a routine zone line, so watches, warnings and fire weather products for this address come out of a different office than for the other half of our map. We sell hurricane work before the season rather than during it, and we refuse topping, hat racking and hurricane cuts here on hardwoods and on palms however the job is asked for.

Palms are quoted as palms besides: no branch collar, no cambium, one growing point, and a trunk that will never thicken again. A palm priced like a hardwood is priced wrong in both directions.
